BIPARTISAN PATIENT PROTECTION LEGISLATION TO BE ON SENATE FLOOR! URGE YOUR SENATORS TO SUPPORT S. 283!

In the next few days, the Senate will begin consideration of S. 283, the Bipartisan Patient Protection Act of 2001, sponsored by Senators John McCain (R AZ), John Edwards (D NC) and Edward Kennedy (D MA). Please call and write your Senators in support of S. 283 today! Tell them NOW is the time for the Senate to pass comprehensive patients’ rights legislation. For the past four years, the League of Women Voters has urged Congress to pass strong bipartisan patient protection legislation that will address some of the most serious problems in managed care today.

The League of Women Voters strongly supports S.283, the Bipartisan Patient Protection Act of 2001, S. 283. This legislation guarantees basic health care protections for patients, including the right to emergency room care using the “reasonably prudent person” standard and the right to have medical information kept confidential. The Bipartisan Patient Protection Act of 2001 will enable patients to receive clear information about different health care plans and establish an appeals process that will resolve grievances in a timely and balanced manner and hold heath care plans legally accountable if they harm a patient.

The League does not support legislation such as S. 889, the Bipartisan Patients’ Bill of Rights Act of 2001, sponsored by Senators William Frist (R TN), John Breaux (D LA) and James Jeffords (I VT). We believe that S. 889 does not provide strong patient protections. S. 889 would establish an appeals process that will put the rights of health plans ahead of patients. It would also give states that have passed state versions of patient’s rights legislation the right to opt out of the federal patient protection law if the state law is determined to be “consistent” with the federal law.

Patient Protections v. Patients Bill of Rights: In previous Congresses, the legislation supported by the League has been entitled “The Patients’ Bill of Rights.” In this Congress, we are supporting the Bipartisan Patient Protection Act of 2001, S. 283. We are opposing the Bipartisan Patients’ Bill of Rights, S. 889. Because of the switch in titles and the possibility that the bill numbers could change or be updated, please be clear with Senators and staff that you are lobbying in support of the McCain/Edwards/Kennedy Bipartisan Patient Protection Act of 2001.

  4. CONTACT YOUR GRASSROOTS NETWORK to generate calls, letters and e-mail. Send this alert to your e-mail address list with a personal note asking them to take action.

THE MESSAGE

  1. The Senate must act NOW to pass real managed care reform. The Bipartisan Patient Protection Act of 2001 Act, S. 283, will establish essential health care protections for consumers. S. 283 is needed to provide genuine patient protections and real managed care reform.

  2. Please oppose bills such as S. 889 that do not provide real managed care reform.
